Terms of service
Terms of Service
1. Introduction
Welcome to Partytjie.
These Terms of Service govern your use of the Partytjie website and any orders placed through our online store.
Throughout these Terms, the terms “Partytjie”, “we”, “us” and “our” refer to Partytjie. The terms “you”, “your” and “customer” refer to any person who accesses our website or purchases products from us.
By accessing our website, placing an order or purchasing a product from Partytjie, you agree to be bound by these Terms of Service, together with our Return & Refund Policy, Privacy Policy and Shipping & Delivery Policy.
If you do not agree with these Terms, you should not use our website or place an order.
Nothing contained in these Terms is intended to limit any rights available to you under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 or any other applicable South African legislation.
2. About Our Products
Partytjie specialises in custom-designed and personalised packaging and related products for events, celebrations and businesses.
Our products may include customised packaging, labels, stickers, boxes, wrappers, bottles, cups, containers, stationery and other personalised items displayed on our website from time to time.
Many Partytjie products are made specifically according to the customer's selected design, wording, colours, theme, branding or other supplied information.
Because these products are personalised and made to order, different terms may apply to cancellations, returns and refunds compared with standard non-personalised retail products.
Please refer to our Return & Refund Policy for further information.
3. Placing an Order
When placing an order, you are responsible for ensuring that all information supplied to Partytjie is complete and accurate.
This includes, where applicable:
-
your name and contact information;
-
delivery information;
-
product selection;
-
quantity;
-
sizes or product variations;
-
names and dates;
-
wording and personalised text;
-
event details;
-
colours and themes;
-
logos, photographs or artwork;
-
spelling and grammar; and
-
any other information required to create your order.
Please review your order carefully before submitting it.
Submitting an order does not necessarily mean that the order has entered production immediately. Where artwork approval is required, production will ordinarily begin only after the final artwork has been approved and any required payment has been received.
4. Order Acceptance
We reserve the right to accept or decline an order where reasonably necessary.
An order may be declined or cancelled before production begins if, for example:
-
a product is unavailable;
-
incorrect pricing has been displayed due to a genuine error;
-
we are unable to fulfil the requested turnaround time;
-
required information has not been supplied;
-
payment has not been received or verified;
-
the requested content infringes intellectual property rights;
-
the requested design contains unlawful, defamatory, hateful or otherwise inappropriate material; or
-
circumstances outside our reasonable control prevent us from fulfilling the order.
Where we cancel an order that has already been paid for and no chargeable work has been completed, the relevant amount will be refunded.
5. Custom Designs and Artwork
Many Partytjie products require custom artwork to be prepared before production.
Where applicable, we may provide you with a digital proof showing how your final product is expected to appear.
A digital proof is intended to provide a reasonable representation of the proposed design. Differences may occur between digital artwork displayed on a screen and the final physical product due to factors including screen settings, materials, printing methods and manufacturing processes.
6. Artwork Approval
It is your responsibility to carefully review the artwork proof before approving it.
You must check:
-
spelling;
-
grammar;
-
names;
-
dates;
-
contact information;
-
event details;
-
colours;
-
layout;
-
logos;
-
photographs;
-
quantities; and
-
any other personalised information.
Once you approve an artwork proof, Partytjie may rely on that approval and proceed to production.
Your approval confirms that you have checked the artwork and consider it correct.
Partytjie will not ordinarily be responsible for errors that were clearly visible on artwork that you approved, including spelling mistakes, incorrect dates or incorrect information originally supplied by you.
This does not apply where the final product materially differs from the artwork that you approved due to an error made by Partytjie.
7. Design Revisions
Where custom design work is included in your order, reasonable revisions may be allowed before final artwork approval.
The number and extent of revisions may depend on the product or service purchased.
Significant changes to the original brief, repeated revisions or requests for entirely new design concepts may result in additional design charges. Where additional charges apply, we will notify you before proceeding with the additional work.
Once final artwork has been approved and production has started, further changes may not be possible.
8. Customer-Supplied Artwork, Images and Logos
You are responsible for ensuring that you have permission to use any logo, image, photograph, illustration, wording, trademark or other material you provide to Partytjie.
By supplying such content, you confirm that:
-
you own the material or have permission to use it;
-
Partytjie's use of the material to fulfil your order will not infringe another person's rights; and
-
the material may lawfully be reproduced for the purpose of producing your order.
You grant Partytjie permission to use, reproduce and adapt the supplied material solely as reasonably necessary to design, produce and fulfil your order.
9. Intellectual Property
Unless otherwise stated, the Partytjie website and its original content, branding, graphics, photographs, designs, layouts and other materials are owned by or licensed to Partytjie.
They may not be copied, reproduced, distributed, sold or used commercially without our prior permission.
Where Partytjie creates original custom artwork for an order, ownership and usage rights in that artwork may remain with Partytjie unless expressly agreed otherwise in writing.
Purchasing a finished personalised product does not automatically transfer ownership of our underlying templates, editable design files or design systems.
Customer-owned logos, photographs, trademarks and other supplied intellectual property remain the property of their respective owners.
10. Portfolio and Promotional Use
We may wish to photograph or display completed Partytjie products for our portfolio, website or social media channels.
Where an order contains sensitive, confidential or private information, you may request that we do not use it for promotional purposes.
Where appropriate, we will respect reasonable requests not to publicly display personalised products.
11. Product Images and Colours
We make reasonable efforts to display products and colours accurately on our website.
However, colours may appear differently depending on:
-
your device;
-
screen brightness;
-
display settings;
-
printing method;
-
material;
-
finish; or
-
production batch.
Minor colour, positioning or finishing variations that are normal for the relevant production method will not necessarily constitute a defect.
Where exact colour matching is essential, you should inform us before approving production.
12. Pricing
Prices displayed on our website are stated in South African Rand unless otherwise indicated.
Prices may change from time to time without notice.
The price applicable to an order will generally be the price displayed or agreed when the order is placed, subject to genuine pricing errors.
Additional charges may apply for services or requirements including:
-
rush production;
-
substantial artwork revisions;
-
specialised printing;
-
additional customisation;
-
special materials;
-
additional quantities; or
-
delivery.
Any material additional charges will be communicated to you before the additional work is undertaken.
13. Payment
Payment must be made using one of the payment methods made available during checkout.
Where PayFast or another third-party payment provider is used, your payment may also be subject to that provider's applicable terms, security procedures and privacy practices.
Partytjie does not control the processing systems of independent payment providers.
Orders may not proceed to production until payment has been successfully received or confirmed, unless otherwise agreed with us.
14. Production
Because our products are personalised, production times may differ between products.
Any turnaround time communicated by Partytjie is generally calculated from the point at which:
-
all required information has been received;
-
final artwork has been approved, where applicable; and
-
payment has been confirmed.
Delays in supplying information, approving artwork or making payment may therefore affect your production and delivery date.
15. Urgent Orders
If your order is required by a specific event date, you must communicate this to us before placing or approving the order.
We will make reasonable efforts to accommodate urgent orders where possible, but accepting an order does not automatically guarantee delivery by a particular event date unless we have expressly confirmed that date.
Rush fees may apply to orders requiring accelerated design or production.
16. Delivery
Orders will be delivered using the delivery method selected or agreed for your order.
Delivery times are estimates unless expressly confirmed otherwise.
Once an order has been handed to a courier or delivery provider, circumstances outside Partytjie's direct control may affect the delivery schedule.
We will nevertheless make reasonable efforts to assist where delivery problems occur.
You are responsible for providing a complete and accurate delivery address and contact details.
Additional delivery charges arising from an incorrect address supplied by the customer, failed delivery attempts or redirection requests may be charged to the customer where reasonable.
Please refer to our Shipping & Delivery Policy for more information.
17. Event Dates
Customers ordering personalised products for an event are encouraged to place their orders with sufficient time for design, approval, production and delivery.
Unless we expressly agree otherwise, Partytjie cannot guarantee that an order will arrive before an event solely because the event date was entered or mentioned during the ordering process.
Any event date supplied to us will be used to assist with planning but does not replace an expressly agreed delivery deadline.
18. Changes and Cancellations
If you need to change or cancel an order, please contact us as soon as possible.
Changes may be possible before artwork approval or production begins.
Once custom design or production work has begun, cancellation or substantial changes may no longer be possible, or reasonable costs already incurred may be deducted where permitted by law.
Once personalised products have entered production, they cannot ordinarily be cancelled merely because you have changed your mind.
Please refer to our Return & Refund Policy for full details.
19. Returns, Defects and Refunds
Returns and refunds are governed by our Return & Refund Policy and applicable South African consumer protection legislation.
Nothing in these Terms removes any statutory rights that may apply where goods are defective, damaged, incorrectly supplied or fail to comply with applicable legal standards.
20. Availability of Products and Materials
Products, colours, papers, packaging, finishes and materials may occasionally become unavailable.
Where a material or product becomes unavailable after an order has been placed, we may contact you to offer:
-
a suitable alternative;
-
an amended product;
-
a revised production timeline; or
-
a refund where an appropriate alternative cannot be agreed.
We will not substitute a materially different product without informing you.
21. Website Information
We make reasonable efforts to ensure that information displayed on our website is accurate.
However, the website may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, delivery charges or availability.
We reserve the right to correct genuine errors and update website information.
Where an error materially affects an order that you have already placed, we will contact you before proceeding where reasonably possible.
22. Website Use
You agree not to use the Partytjie website:
-
for unlawful purposes;
-
to infringe another person's intellectual property rights;
-
to submit false or misleading information;
-
to upload viruses or malicious code;
-
to attempt unauthorised access to the website;
-
to interfere with the security or operation of the website; or
-
in any manner that could damage Partytjie or other website users.
We reserve the right to restrict access to the website where reasonably necessary to protect our systems, customers or business.
23. Third-Party Services
Our website may use or link to third-party services, including Shopify, payment providers, couriers and social media platforms.
These services are operated independently and may have their own terms and privacy policies.
Partytjie is not responsible for the independent operation of third-party websites or services, except to the extent that applicable law provides otherwise.
24. Personal Information
We collect and process personal information as reasonably necessary to operate our store, process orders, communicate with customers and provide our services.
Personal information will be handled in accordance with our Privacy Policy and applicable South African privacy legislation.
Please review our Privacy Policy for further information.
25. Limitation of Liability
To the maximum extent permitted by applicable law, Partytjie will not be liable for indirect or consequential losses arising from circumstances outside our reasonable control.
This may include losses caused by:
-
courier delays;
-
incorrect information supplied by the customer;
-
customer-approved artwork errors;
-
events being cancelled or postponed;
-
third-party service interruptions; or
-
circumstances commonly regarded as force majeure.
Nothing in this section is intended to exclude or limit liability where doing so would be prohibited under South African law.
26. Events Beyond Our Reasonable Control
Partytjie will not be responsible for delays or failure to perform obligations where caused by events reasonably beyond our control.
Such events may include:
-
power outages;
-
internet or telecommunications failures;
-
severe weather;
-
natural disasters;
-
strikes;
-
civil unrest;
-
transport disruptions;
-
courier interruptions;
-
supplier shortages;
-
equipment failures;
-
governmental restrictions; or
-
other comparable circumstances.
Where such an event materially affects an order, we will make reasonable efforts to communicate with you and find an appropriate solution.
27. Consumer Rights
Nothing in these Terms is intended to waive, restrict or exclude any consumer right that cannot lawfully be waived, restricted or excluded.
Where these Terms conflict with a mandatory provision of South African law, the applicable law will take precedence.
28. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Any dispute relating to these Terms or a purchase from Partytjie will be dealt with in accordance with applicable South African law.
29. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes to our products, services, website or legal obligations.
The version published on our website at the time of your transaction will ordinarily apply to that transaction.
30. Contact Us
If you have questions about these Terms, your order or any Partytjie product, please contact us using the contact information provided on our website.
We encourage customers to contact us directly if there is a problem with an order so that we can make reasonable efforts to resolve the matter promptly.
